9/22/19 to ALG
Hi Helen,
My mom and I have reviewed the documents sent to me on 8/9/19. Jean is ready to execute them upon her return to LI in October.
There are 4 items that she needs clarifcation or modification on
- Are you all set with the documents? In particular, do you have everthing you need regarding the New Hampshire property? Many of those documents are stored in New Hampshire. They can be easily copied as needed while Jean is still here.
- Are there any issues around capital gains that would determine which residence is better designated as the primary residence?
- regarding Erin:
- It is my mom's intention that Erin receive her car in her inheritance though we did not see any indcation of that in the documents.
- We ask for clarification in how the trust for Erin operates. Is there a monthly payment sent to Erin? How is that typically calculated? Are there other mechanisms around the dispersal of funds that we need to educate ourselves about?

re: Ansanelli Law Group (ALG) response email or 9/25/19
This part sounds terrible for Erin and not in line with your intentions:
4. The Supplemental Needs Trust established for Erin is to be used to enhance the quality of her life. It should not be used to pay for any services which are covered by governmental benefits (ie: rent, medical, etc.). Also, you should be aware that under no circumstances should any money from the Trust ever be paid directly to Erin or her benefits could be jeopardized. A monthly "allowance" or other similar payment to Erin is n to permitted. You can use the Trust funds to make direct payments to a service provider.
So I think we need to do a little more research before you sign these documents.
- Do you know what kind of disability that Erin is getting?
from a 2013 source https://www.disability-benefits-help.org/blog/inheritance-ssdi
- "If you are a Social Security Disability Insurance (SSDI) recipient and receive an inheritance, it will not affect your benefits. SSDI is not a needs-based program and is not contingent upon your unearned income—including inheritance...
- However, if you are receiving Supplemental Security Income (SSI) benefits and have recently inherited funds, your benefits may potentially be affected. This is due to the fact that the SSI program is based on financial need. Any income, earned or unearned, can affect your benefits."
from 2018 Motley Fool: https://www.fool.com/personal-finance/2019/08/29/when-will-stop-getting-social-security-disability.aspx
- 4. Exceeding asset limits
- SSDI doesn't have asset limits, but SSI does. If you have more than $2,000 ...for example, if you receive an inheritance or a generous cash gift...you will not be approved for benefits.
another potential wrench in the works if it is SSI that Erin gets
- Reaching retirement age on SSI
- When you reach retirement age and are receiving Supplemental Security Income...if you receive a $700-per-month Social Security retirement benefit, SSI benefits would be reduced by $700 and you'd get just $71 monthly from SSI to supplement your retirement benefits.
I guess that means that you should stay alive until Erin reaches retirement age since then she will be getting regular retirement social security and inheritance doesn't change that.:)
So I would suggest: 1. talking to Erin and finding out if she is getting SSDI or SSI. 2. after we find out then get back to ALG about what we have found.

Hi mom,
You have till around the 10th of December to decide if your phone suits you. Up til then you can return it for a nominal fee.
Here are the things you want to make sure are OK with it.
- good reception for calls
- WIFI works in house
- you don't get charged for data (pictures, video, file download, web, email) when you are using WIFI (that's why people hang out in coffee shops)
- data works (when not on WIFI)
- data (pictures, video, Google GPS navigation, file download, web, email) should now work when you are away from home. It didn't work when you left JP since we set it up outside US Cellular area. Make sure it does now otherwise the phone is no good. (You can call me and I can help you determine this)
- You should be starting to understand and like the phone. If not we could get you an iphone.
So spend some time figuring this stuff out or have me or the store in Keene help you. After ~12/10 there is no way out of the contract.
Tim
